Frequently Asked Questions

Key legal rules, income requirements, and statutory obligations for setting up your Czech trade license (Živnostenský list).

Do I need to have a confirmed Czech client before I apply?
You do not need an active long-term service contract, but the Ministry of the Interior and consular officers require tangible proof of economic viability. The gold standard is submitting 1 to 3 Letters of Intent or future cooperation agreements (smlouva o budoucí spolupráci) from Czech or EU clients. These confirm that prospective clients intend to purchase your freelance services once your trade license and visa are active.
Can I work as a regular employee on a Freelancer Visa?
No. A freelance visa (issued on the basis of a trade license / Živnostenský list) registers you as a sole proprietor (OSVČ). You cannot sign a standard Czech employment contract (HPP). If an employer wants to hire you on payroll, you must apply for an Employee Card. You are legally permitted to issue invoices as an independent contractor (B2B), provided the working relationship complies with statutory anti-false employment laws (avoiding švarcsystém).
What are the mandatory monthly contributions for freelancers in Czechia?
Once active as an OSVČ, you are legally responsible for monthly social security (ČSSZ) contributions and health insurance. Many non-EU freelancers choose to register for the Czech Flat Tax Regime (paušální daň), which bundles your income tax, social security, and public healthcare into a single fixed monthly payment, dramatically simplifying accounting and eliminating end-of-year tax filing stress.
What is the difference between my business seat (Sídlo) and residential address?
A Business Seat (Sídlo) is the official registered address where your Trade License is legally tied. Czech law fully permits using a verified virtual office provider for your business seat. However, for your personal visa and residence status, the Ministry of the Interior (OAMP) requires an actual, habitable residential address confirmed through a signed lease or notarized Confirmation of Accommodation (potvrzení o ubytování). We provide compliant business seat services to register your trade license immediately.
Is the proof of funds deposit spent or locked during the process?
No. The required proof of financial funds (typically ~170,000 CZK, calculated based on statutory subsistence minimums) is not paid to the government and is not held in escrow. You only need to provide an official stamped bank statement showing the funds are in your personal account, accompanied by an internationally valid debit or credit card linked to that account.
How long is the initial Freelancer Visa valid, and how do renewals work?
Your initial long-term visa (Type D/VC for business) is issued for up to 12 months. Between 120 days and the final day of validity, you apply inside the Czech Republic at the Ministry of the Interior (OAMP) for a Long-Term Residence Permit for business purposes (dlouhodobý pobyt za účelem podnikání). This subsequent permit is granted as a 2-year biometric card and can be repeatedly renewed.
Can I apply for the Freelancer Visa from inside the Czech Republic?
You can only apply from inside the Czech Republic if you already hold a valid long-term residence permit (such as a student permit or employment card) and qualify to change your purpose of stay (změna účelu pobytu). First-time applicants on short-stay tourist visas or visa-waiver status must file in person at a Czech diplomatic mission abroad (such as the Dresden Visa Center in Germany for eligible nationalities, or your home country’s embassy).
